Terms of Service

These Terms of Service ("Terms") govern your use of the Lingo Mark web application and browser extension (together, the "Service"), operated by Lingo Mark ("Lingo Mark", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please also read our Privacy Policy, which explains how we handle your information.

1. Eligibility

You must be at least 14 years old (or the minimum age of digital consent in your country) to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

  • You are responsible for keeping your login credentials and your extension API key confidential, and for all activity under your account.
  • Notify us at support@lingomark.app if you believe your account or API key has been compromised.
  • You may not share, sell, or transfer your account to anyone else.

3. The Service

Lingo Mark lets you clip web pages, highlight and collect vocabulary, annotate reading materials, and study words in context, across a web app and a browser extension. We may add, change, or remove features over time.

4. Your content

  • You own the content you create — your wordbooks, notes, annotations, and the pages and words you clip. We do not claim ownership of it.
  • You grant us a limited license to store, process, and display your content back to you (and to anyone you deliberately share a material with via a share link) solely to operate and provide the Service.
  • Clipping third-party content is your responsibility. The Service lets you save text and pages you find online. You must only clip content you are legally entitled to save, and you must use it for your personal, non-commercial study — for example, under fair use / fair dealing or with the rights holder's permission. Do not use the Service to reproduce or redistribute others' content in violation of their rights.
  • If you create a share link, you are responsible for what you make accessible through it. You can disable a share link at any time.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of others' rights, including intellectual-property or privacy rights.
  • Attempt to access accounts, data, or systems that are not yours.
  • Probe, scan, overload, or disrupt the Service, or bypass its security, rate limits, or plan limits.
  • Use automated means to scrape or bulk-collect content except through the official extension and API as intended.
  • Reverse engineer the Service except to the extent that restriction is prohibited by law.

We may suspend or terminate accounts that violate these Terms.

6. Plans and limits

The Service offers Free, Plus, and Pro plans. Each plan sets limits on how many learning materials, wordbooks, and words you can create, as described in the app. Reaching a limit prevents creating new items of that type; it never deletes or hides content you already have.

Payment and billing. Paid plans are sold through Creem, which acts as the merchant of record (the seller of record) for your subscription. Checkout, recurring billing, applicable taxes, and refunds are handled by Creem under Creem's own terms; your card details never touch Lingo Mark. Applicable prices and billing intervals are shown at checkout and on the pricing page, and subscriptions renew automatically until cancelled. You can view, change, or cancel your subscription anytime through Creem's customer portal.

7. The browser extension

The extension requires broad permission to run on the pages you visit so it can clip pages and collect words wherever you read. It only sends data to your account when you explicitly clip a page or collect a word, as described in the Privacy Policy. You are responsible for installing it from an official source and keeping it updated.

8. Intellectual property

The Service itself — its software, design, branding, and the built-in dictionary content as compiled and presented — is owned by Lingo Mark or its licensors and protected by law. These Terms do not grant you any right to our trademarks or branding.

9. Third-party content and links

The Service may display content from, or link to, third-party websites and dictionaries. We are not responsible for third-party content, and your use of it is subject to those third parties' own terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that dictionary definitions, phonetics, or other language content are accurate or complete. Language content is for study reference only.

11. Limitation of liability

To the maximum extent permitted by law, Lingo Mark will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, the sections that by their nature should survive (such as content ownership, disclaimers, and limitation of liability) will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws applicable at our place of operation, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence still apply to you. Where required by local law, disputes may be brought in the courts of your place of residence.
